Essa questão aborda o tema do trabalho externo para presos. O Código Penal permite que detentos em regime fechado realizem trabalho externo, desde que seja em serviços ou obras públicas (art. 34, §3º, CP).
Além disso, a Lei de Execução Penal (LEP) dispõe que: “O trabalho externo será admissível para os presos em regime fechado somente em serviço ou obras públicas realizadas por órgãos da Administração Direta ou Indireta, ou entidades privadas, desde que tomadas as cautelas contra a fuga e em favor da disciplina” (art. 36). O mesmo artigo ainda estabelece:
§1º O número de presos alocados será limitado a 10% do total de empregados na obra.
§2º A responsabilidade pelo pagamento da remuneração caberá à administração, entidade ou empresa contratante.
§3º O trabalho para entidades privadas depende da concordância expressa do preso.
A LEP também apresenta critérios adicionais. Conforme o art. 37, a autorização para o trabalho externo depende de aptidão, disciplina e responsabilidade do preso, além de ter cumprido, no mínimo, 1/6 da pena, requisito aplicado exclusivamente aos detentos do regime fechado. Já no caso de presos em regime semiaberto, é possível trabalhar externamente desde o início do cumprimento da pena.
O STF, em decisão proferida pelo Plenário (EP 2 TrabExt-AgR/DF, Rel. Min. Roberto Barroso, julgado em 25/6/2014 – Info 752), confirmou que o reuisito de cumprimento de 1/6 da pena para trabalho externo é exigido apenas para presos no regime fechado.
Portanto, a afirmativa está errada, já que o direito ao trabalho externo não é exclusivo dos presos em regimes semiaberto e aberto. A legislação também prevê essa possibilidade para detentos em regime fechado, embora com condições mais rigorosas.
