Art. 1.510-A. O detentor de uma construção-base tem o direito de conceder a superfície superior ou inferior de sua edificação para que o possuidor da laje mantenha uma unidade separada daquela originalmente construída sobre o solo.
§ 3° Os detentores da laje, unidade imobiliária autônoma registrada em matrícula própria, têm a prerrogativa de utilizá-la, desfrutá-la e dispor dela. (LETRA E);
§ 4° A instituição do direito real de laje não implica na atribuição de fração ideal de terreno ao possuidor da laje ou na participação proporcional em áreas já edificadas. (LETRA A)
Art. 1.510-D. Em caso de alienação de qualquer das unidades sobrepostas, terão o direito de preferência, em condições iguais às de terceiros, os detentores da construção-base e da laje, nesta ordem, que serão notificados por escrito para que se manifestem no prazo de trinta dias, exceto se o contrato estipular de maneira diferente.
§ 2° Se houver mais de uma laje, terá prioridade, sucessivamente, o possuidor das lajes ascendentes e o possuidor das lajes descendentes, com garantia de precedência para a laje mais próxima à unidade sobreposta a ser alienada. (LETRA B)
Art. 1.510-E. A ruína da construção-base resulta na extinção do direito real de laje, a menos que:
I – tenha sido instituído sobre o subsolo; (LETRA C)
